O’Rourke is currently facing threats of jail time from Texas Attorney General Ken Paxton, who accused him of violating a court order by continuing to fundraise for Texas Democrats who had left the state to stop Republicans from gerrymandering in their favor.

The former representative did not stop his attack on what Cruz does in his free time. He told Minhaj that the Republican’s alleged role in inciting the riot at the Capitol on Jan. 6, 2021, “should bar him from any public service and really should prompt an investigation by the Department of Justice.”
